# I. Overview

1.1 Purpose and basis: In order to maintain a fair and harmonious business atmosphere in the WeChat service market and protect the legitimate rights and interests of both parties, To maintain the normal operation order of the WeChat service market, this specification is formulated in accordance with the "WeChat Open Platform Operation Specifications," "WeChat Service Market Third-Party Service Provider Terms of Service" and other relevant agreements and rules.

1.2 Scope of application: 本规范适用于入驻微信服务市场小程序代开发服务专区的服务商。在区域方面,本规范只适用于中华人民共和国大陆境内交易产生的纠纷,涉及到此范围以外的争议,不适用本规范。

1.4 Definition of terms

1.4.1 WeChat Service Market: refers to the platform provided by Tencent for eligible service providers to settle in and provide relevant information and services to WeChat users, Tencent provides these third party service providers with internet related technical services, including internet information dissemination, service setup and match, self-service flow of services, etc.

1.4.2 Third party service providers: Hereinafter referred to as "service providers" refers to institutions that, after valid registration, application and certification, access their third-party platforms with corresponding rights to the WeChat service market and provide merchants with third-party platform-related services including but not limited to mini program development services, mini program development services and other third-party platform related services.

1.4.3 merchant: Refers to the subject who applies for or uses the Service and is more commonly referred to as a "User" in these Terms.

# II. Operation and Management

2.1 Products on Shelves: The services listed by service providers, in addition to complying with the "WeChat Service Market Mini Program Development Service Access and Audit Rules," must also comply with the following requirements:

2.1.1 The service on the shelf must be safe and feasible.

2.1.2 Service providers must have all the qualifications required for the sale or distribution of listed services.

2.1.3 The same service goods may not be repeated.

2.1.4 The Service may not contain the following information/Behavior:

Contains content that infringes the legal rights or interests of any third party, including but not limited to the intellectual property rights of third parties. Contains any type of malicious computer programs, viruses, system vulnerabilities. Can take other people's ID card, email, mobile phone number, bank account, Tenpay account and other personal or corporate privacy issued information products. The product information description (including but not limited to the title, picture, label, price, service description, etc.) should be consistent and accurate, and there is no external link address embedded in non-WeChat products, and it is not allowed to deliberately copy the store and product information of other service providers that have already entered the platform. Other content that violates laws and regulations, violates national policies or violates the norms of the WeChat service market.

2.2 Tariff standard

Service providers can set up a maximum of one free package, but at the same time must set up at least one fee package, the price of the fee package must not be less than 25 yuan/Month. If the service package is charging for commission, the range of commission proportion should be described in detail.

2.3 Service delivery

After the User subscribes to the Service, the Service Provider shall activate the Service Content for the User within 2 working days, including signing the Service Contract./Agreements, arrangements for Commissioner docking, etc. And feedback on the status of the order within a maximum of 30 days. For the Platform's inquiries about the order service process, the Service Provider is obliged to make a true statement to the Platform.

2.4 Online Customer Service: After the product is put on the shelves, service providers need to provide efficient and secure online customer service. Ensure that customer service personnel respond in a timely manner, the response content is professional and credible.

2.5 After Sale Service: Service providers must provide after-sales service for the products they sell on the WeChat service market.

2.5.1 After-sales service mode and time After the product is sold, the service provider needs to provide after-sales support to the end user, such as telephone support, technical support, product support, etc. Specific reference to the relevant agreement in the service provider's product description.

Service providers from Monday to Sunday (09: 00 - Online service is available at 18: 00.

Customer service hours can not appear customer service offline or customer service phone unanswered.

Because the service provider's goods are not available, the service provider must provide users with alternatives, data backup migration services and other solutions.

2.5.2 Service Commitment: In the course of the transaction, the Service Provider shall provide services to the users in accordance with the agreement (including but not limited to the order content, the service commitment made by the Service Provider to the users, etc.).

2.6 Service provision

2.6.1 The service provider shall ensure the stability of the service function, respond to the service request of the business in a timely manner, ensure the stability of the server, ensure the security of the service function, and ensure that the service can be accessed normally.

2.6.2 Service providers shall operate in a formal manner, and shall not operate in violation of the rules and regulations of the WeChat service market in any form, and shall not engage in acts of unfair competition. 2.6.3 Service Provider shall properly and reasonably use the Service Operational Data, and shall not store, display, aggregate, disclose, use or authorize others to use it in any form.

2.6.4 In order to ensure the security and stability of the services provided, the Service Provider shall actively cooperate with the security audit of the platform, including but not limited to the following forms: log return, system stress test, system performance test, offline visit research, etc.

2.7 Prohibition of false transactions: The Service Provider shall not increase the sales or rating of the Service Provider by improper means:

2.7.1 The service provider guides the user to purchase the product or service, and then makes the remittance, transfer or recharge to the user and carries on the disguised refund behavior.

2.7.2 The act of a service provider purchasing its own services as a buyer or entrusting another person to purchase its own services as a buyer.

2.7.3 Including but not limited to the acts listed above.

2.8  Prohibition of unfair competition: Service providers shall be honest and trustworthy, and shall not engage in unfair competition in various ways:

2.8.1 The service provider makes a malicious evaluation after purchasing peer services as a buyer user.

2.8.2 Maliciously report other service providers, such as providing false testimony.

2.8.3 Including but not limited to the above actions.

# III. Regulating Daily Operations

3.1 Code of conduct: Service providers shall comply with the following Code of Conduct when providing services in the WeChat Service Market:

3.1.1 True and valid information: All information and materials submitted or filled in by the Service Provider shall be true, accurate and valid, and no false qualifications or false information shall be used.

3.1.2 The service process is professional and courteous, and shall not abuse, intimidate or threaten users.

3.1.3 The Vendor shall not collect non-essential information in the course of the Service, and the information collected shall only be used for the Service.

3.1.4 Legitimate copyright: When the product provided by the service provider is held accountable by the copyright owner due to copyright issues (including the situation where the WeChat service market receives a complaint or has reasonable grounds to judge), the service provider shall take effective measures to stop the infringement.

3.1.5 The Service Provider shall not mislead or confuse others into thinking that the Service Provider is a subsidiary, branch, affiliate, agent or other entity of the Tencent Group, nor shall the Service Provider be recognized or recommended by the Tencent Group. Unless otherwise agreed by the parties.

# IV. Handling of Violations

4.1 Violation handling rules 4.1.1 The WeChat service market carries out independent penalties for service providers, including but not limited to shielding, removal, restriction of release, account restriction, withdrawal, etc.

1)Shield, means that the service will not be displayed and purchased in the WeChat service market list, users who have subscribed to the service and are still in the service cycle can continue to use and renew.

2)Restricted releaseThe service provider will not be able to launch new services. The original service cannot be modified, but it can still be displayed and purchased.

3)Account Restrictions, means that the service provider will not be able to release new services, all services shall not be modified, and the capital account will be frozen, and the revenue obtained by the service provider in the WeChat service market will not be settled to the service provider.

4)Retreat, refers to the service provider to passively withdraw from the WeChat service market, clear all services under the service provider's name, and limit the release.

4.1.2 If the service provider and the service issued by it violate the rules, the WeChat service market will give different types of treatment according to the degree of violation, at the same time suspend all online operation and promotion resources, and give the service provider deduction points and publicity warning.

4.1.3 The rules for handling violations by service providers shall be dealt with according to the deduction system, and if the accumulated deduction points for violations in a natural year are full of 12 points, the service market shall give the service provider a refund penalty. If the penalty is not 12 points, the penalty points will be cleared at 24: 00 on December 31 of each year.

4.1.4 Service providers and services that have been processed due to violations can resume their normal status only after all violations have been corrected and the processing period has expired.

4.1.5 The service market is managed and punished in the dimension of all accounts and services involved in the same service provider. If the actual controller of multiple service provider accounts is the same person using the same identity authentication information or confirmed by the service market investigation, they are all regarded as the same service provider. If the service provider or its published service violates the rules, the service market has the right to impose the same degree of punishment on all accounts and services involved in the same service provider.

4.2 Violations and Handling

# V. Withdrawal from management

5.1  Active withdrawal: Service providers have the right to remove products or apply to withdraw from the WeChat service market according to their actual business situation.The order service provider that has not completed the order after the product is removed from the shelf still needs to be completed normallyDuring the acceptance period of the withdrawal application, the service provider shall not stop the service without permission, resulting in the user being unable to use the service normally.

5.2 Retreat: In the event of serious violations in the operation of the service provider, the WeChat service market has the right to immediately withdraw it from the WeChat service market and permanently seal the account, and may not re-enter the account permanently.

5.3 Post-exit business processing: When the Service Provider exits, the transactions that have been concluded between the Service Provider and the User shall be handled as follows:

5.3.1 If the user project that purchased the service or product of the service provider has not been completed or has not been started, the full refund operation will be carried out.

5.3.2 After the withdrawal of the service provider, the relevant after-sales services for the WeChat service market products sold by the service provider shall be provided by the service provider through consultation with the user.

# VI. Supplementary Provisions

6.1 This specification comes into force on January 1, 2021.

6.2 WeChat service market service provider behavior, occurred before the date of entry into force of these norms or the date of revision, the then-applicable normsOccurred on the effective date of this specification or after the date of revision, this specification shall apply.

6.3 WeChat Service Market reserves the right to revise these Management Practices according to the market environment, the development status of the cooperation system of partners and other factors.
