# Policy and regulatory basis
Article 10 of Regulations of the People's Republic of China on Road Transport
Where an applicant applies for engaging in passenger transport business operations, it shall, after going through the relevant registration formalities with the administrative department for industry and commerce, file an application in accordance with the following provisions and submit relevant materials that meet the conditions as prescribed in Article 8 of these Regulations:
(1) To apply to the road transport administrative organ at the county level for engaging in the passenger transport business within the administrative region at the county level
(2) To apply to their common road transport administrative organ at the next higher level for engaging in passenger transport business operations across two administrative regions at or above the county level within the administrative area of a province, autonomous region or municipality directly under the Central Government
(3) To engage in cross-province, autonomous region or municipality directly under the Central Government passenger transport business operations, an application shall be filed with the road transport administrative organ of the province, autonomous region or municipality directly under the Central Government where it is located. In accordance with the provisions of the preceding paragraph received an application for road transport management, shall be from the date of acceptance of the application within 20 days of the completion of examination, make a decision to permit or not permit. Where a permit is granted, a road transport business license shall be issued to the applicant, and a vehicle business license shall be allocated to the vehicles put into transport by the applicantIn case of disapproval, the applicant shall be notified in writing and the reasons therefor shall be stated. For applications for inter-provincial, autonomous regional, and municipal passenger transport operations, the relevant provinces, autonomous regions, and municipalities directly under the Central Government The road transport administrative organ of a municipality directly under the Central Government shall, before issuing a road transport business license in accordance with the second paragraph of this Article, consult with the road transport administrative organ of the province, autonomous region or municipality directly under the Central Government at the destination of the transport routeIf consultation fails, it shall be reported to the competent department of communications under the State Council for decision.
