Article 9 of the Measures for the Administration of Patent AgencyThe approval procedures for the establishment of a patent agency are as follows:

(1) To apply for the establishment of a patent agency, an application shall be filed with the intellectual property office of the province, autonomous region or municipality directly under the Central Government where it is located. Upon examination, if the intellectual property office of a province, autonomous region or municipality directly under the Central Government considers that it meets the conditions as prescribed in these Measures, it shall report the application to the State Intellectual Property Office for approval within 30 days from the date of receipt of the applicationWhere it is found that the conditions as prescribed in these Measures are not met, it shall notify the applicant in writing within 30 days from the date of receipt of the application.

(2) The State Intellectual Property Office shall approve applications that meet the conditions specified in this scheme within 30 days from the date of receipt of the reported materials, notify the reported provincial, autonomous and municipal intellectual property offices, and issue patent agency registration cards and agency codes to the newly established institutions.For applications that do not meet the conditions set out in these Measures, it shall, within 30 days from the date of receipt of the submitted materials, notify the intellectual property office of the province, autonomous region, or municipality directly under the Central Government that has been submitted to the Central Government to re-examine them.
