[Policy Basis]
1. Article 25 of the Road Transport Regulations of the people's Republic of China
To apply for engaging in freight transport business, an application shall be filed in accordance with the following provisions and the relevant materials that meet the conditions as prescribed in Articles 22 and 24 of this Regulation shall be submitted respectively: (one)To engage in freight transport operations other than the transport of dangerous goods, an application shall be filed with the road transport administrative organ at the county level (two)To engage in the business operation of transport of dangerous goods, an application shall be filed with the road transport administrative organ at the districted city level. In accordance with the provisions of the preceding paragraph received an application for road transport management, shall be from the date of acceptance of the application within 20 days of the completion of examination, make a decision to permit or not permit. Where a permit is granted, a road transport business license shall be issued to the applicant, and a vehicle business license shall be allocated to the vehicles put into transport by the applicantIn case of disapproval, the applicant shall be notified in writing and the reasons therefor shall be stated. A freight forwarder shall go through the relevant registration formalities with the administrative department for industry and commerce according to law upon the strength of the road transport business license.
II. Article 2 of the Measures for the Access Licensing of Railway Transport Enterprises
An enterprise legal person registered in accordance with the law within the territory of the People's Republic of China that engages in the business of public transport of railway passengers and goods shall file an application with the State Railway Administration and obtain a railway transport license upon examination. Involving local railway operations, the State Railway Administration shall invite the relevant departments of the people's governments of the provinces, autonomous regions and municipalities directly under the Central Government where the applicant is located to participate in the review.
III. Announcement of the Ministry of Transport on Issuing the In-process and Post-process Supervision Measures after the Cancellation and Delegation of Ten Communication and Transportation Administrative Licensing Items
- Interim and ex post regulatory measures after the cancellation of the "Examination and Approval of the Transport Business of International Container Ships and General Cargo Ships" After the examination and approval is cancelled, it shall be put on record, and the relevant recordation work shall be carried out by the provincial communication and transportation departments. All provincial competent departments of communication and transportation may handle recordation and other relevant business by using the unified flow of the ministerial-level comprehensive administration information system for waterway transport construction. If handling such business by using their own systems, they must achieve data docking with the ministerial-level system. The Business Permit of the People's Republic of China for International Shipping which has been issued by the Ministry of Communication and transportation and whose business scope is the international carriage of general cargoes by vessels and the international carriage of containers by vessels shall be abolished.
II. Interim and ex post regulatory measures after the cancellation of the "Permit for Engaging in the Transport of Container Ships and General Cargo Ships between the Mainland and Hong Kong and Macao" After the examination and approval is cancelled, it shall be put on record, and the relevant recordation work shall be carried out by the provincial communication and transportation departments. All provincial competent departments of communication and transportation may handle recordation and other relevant business by using the unified flow of the ministerial-level comprehensive administration information system for waterway transport construction. IV. Provisions on Business Licensing of Public Air Transport Enterprises
Article 21 If the CAAC approves the business license, it shall, within 10 working days from the date of making the decision, issue the business license for the public air transport enterprise to the applicant. Where the business license is not granted, it shall, within 10 working days from the date of making the decision, notify the applicant in writing, explain the reasons, and inform the applicant that it has the right to apply for administrative reconsideration or bring an administrative lawsuit according to law.
