Article 12 of Law of the People's Republic of China on the Promotion of Non-governmental Education

The educational administrative departments of the people's governments at or above the county level shall examine and approve the establishment of non-state schools offering diploma education, early childhood education, self-taught examination and other cultural education. The establishment of a privately-run school that conducts vocational qualification training and vocational skills training mainly based on vocational skills shall be examined and approved by the administrative department of human resources and social security of the people's government at or above the county level in accordance with the limits of authority prescribed by the state, and a copy thereof shall be sent to the administrative department of education at the same level for archival purposes.
