1. Article 6 of the Measures for the Administration of Refined Oil Market

An enterprise that applies for the qualification to engage in the retail operation of refined oil products shall file an application with the competent commerce department of the people's government at the municipal level (a districted city, the same below) where it is located. After examination, the administrative department of commerce of the people's government at the prefecture or city level shall report the preliminary examination opinions and application materials to the administrative department of commerce of the people's government at the provincial level. The competent commerce department of the provincial people's government shall decide whether to grant the retail business license for refined oil.

II. Article 35 of the Regulation on the Safety Administration of Hazardous Chemicals (2013 Amendment)

An enterprise engaging in the business operation of highly toxic chemicals and explosive hazardous chemicals shall file an application with the work safety supervision and administration department of the local people's government at the districted city level, Enterprises engaged in the operation of other hazardous chemicals shall submit applications to the supervisory authority for production safety at the county level of the local people's government (those with storage facilities shall apply to the municipal government's production safety supervision and management at the local district). The applicant shall submit the certification materials that it meets the conditions prescribed in Article 34 of these Regulations. The work safety administrative department of the people's government at the level of a districted city or the work safety administrative department of the people's government at the county level shall conduct examination according to law. It shall conduct on-site verification of the business premises and storage facilities of the applicant, and make a decision of approval or disapproval within 30 days from the date of receipt of the certification materials. If approval is granted, a hazardous chemical business license shall be issuedIf the approval is not approved, the applicant shall be notified in writing and the reasons shall be explained.
