# Policy and Regulation Basis

1. Article 4 of the Measures for the Administration of Food Business Licensing

The principle of "one place, one license" shall apply to the food business license, that is, a food business operator engaging in food business activities at a business site shall obtain a food business license.

2.Article 35 of Food Safety Law of the People's Republic of China

The State implements a licensing system for food production and marketing. To engage in food production, food sales and catering services, a license shall be obtained in accordance with law. However, the sale of edible agricultural products and the sale of only pre-packaged foods do not require a permit. Where only pre-packaged food is sold, it shall be reported to the food safety supervision and administration department of the local people's government at or above the county level where it is located for the record.

3. Article 7 of the Provisions on the Supervision and Administration of Food Hygiene at Frontier Ports

Before engaging in food production and marketing activities at ports, a food production and marketing entity shall apply to the local customs for a Frontier Port Sanitation License of the People's Republic of China.
